EXCLUSIONARY ZONING

The “Not in My Back Yard” (NIMBY) factor is an unfortunate reality.

Zoning that operates to exclude a class protected under the law may be illegal.

If the attack is grounded on the Constitution, the plaintiff will have the burden of proving purposeful discrimination as defined in the Supreme Court’s opinion.
