REFUSALS TO MAKE REASONABLE ACCOMMODATION AND MODIFICATIONS FOR PERSONS WITH DISABILITIES

ACCESSIBLE NEW MULTI-FAMILY CONSTRUCTION

The Act requires that certain multifamily dwellings designed or constructed for first occupancy after March 31, 1991, meet defined design and construction requirements to make them accessible to handicapped persons.

The requirements are minimal and can be met with little or no additional cost if done at the time of construction.

They are carefully spelled out in HUD’s Fair Housing Act Design Manual, which is available from HUD. Compliance with the manual will be considered by HUD to be compliance with the requirements of the Act.
