Discriminatory Restrictive Covenants

  1. Discriminatory covenants were once common in deeds, but in 1948 the Supreme Court held that such covenants were unenforceable.
  2. These covenants may still appear in deeds; they are unenforceable, but it does not affect the validity of the conveyance.
